Planning and Development Law in Malta

Development planning is one of the most contested areas of Maltese law, and one where the firm has particular depth. Dr Alec Sladden’s dissertation, "Article 80 of the Development Planning Act: A Critical Analysis", was written on this subject.

Supporting an application

We support planning applications and advise on the policy framework applying to a site before an application is prepared. Applications succeed or fail against policy, and understanding which policies bite on a particular site is worth more than any amount of argument afterwards.

Objecting to development

We also act for objectors, including residents and local councils, where a proposal affects a locality. Objections have to be made within defined windows and have to engage with the policy framework rather than simply expressing opposition. We advise on standing, on the strength of the objection, and on whether an appeal has realistic prospects.

Planning and property together

A planning problem is usually also a property problem. A condition attached to a permit can change what a developer is able to sell, and an enforcement notice can stall a transaction entirely. We handle both sides of that together rather than treating them as separate matters.

Common questions

Can I object to a development near my property?
In appropriate cases, yes, within the defined window. The objection needs to engage with planning policy, and we advise on standing and on the strength of the case.
What can be done about an enforcement notice?
There are routes to respond, including appeal and, in some cases, sanctioning. Time limits apply, so take advice promptly.
Do planning conditions affect a sale?
They can, materially. Conditions should be checked before a promise of sale rather than discovered at the final deed.
